1. Scope
These Terms & Conditions govern your use of openbandwidth.live and any related OpenBandwidth services, APIs, tools, or support workflows.
By using the website, joining the waitlist, purchasing access, or interacting with the service, you agree to these terms.
2. Service overview
OpenBandwidth provides flat-rate AI inference access and related developer workflows. Access levels, limits, concurrency, and plan details may vary by product tier, launch stage, or order details.
We may rely on third-party infrastructure and providers to operate the service. Availability, latency, and model access may depend on those underlying providers.
3. Accounts and access
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You must provide accurate information when signing up or contacting us. We may suspend or restrict access if we believe information is false, abusive, or used to bypass service controls.
4. Acceptable use
You may not use OpenBandwidth for unlawful, abusive, or harmful activity, including but not limited to:
- Generating or distributing illegal or exploitative content.
- Attempting unauthorized access, scanning, intrusion, denial-of-service activity, or abuse of other systems.
- Using the service to impersonate others, conduct fraud, or perform social engineering.
- Sharing access in ways that violate your plan, our policies, or service integrity.
5. Customer responsibilities
You are responsible for your prompts, data, outputs, internal usage policies, and compliance with laws applicable to your business and users.
You are also responsible for securing your API keys and ensuring they are not exposed in public repositories, client-side applications, or unsecured environments.
6. Billing and payments
Pricing, billing frequency, and plan details will be communicated through the website, product materials, or direct order arrangements.
Unless otherwise stated in writing, fees are non-refundable once paid. We may suspend access for failed or overdue payments.
7. Intellectual property and data
OpenBandwidth and its related materials, branding, and software remain our property or the property of our licensors.
You retain rights to the prompts, inputs, and other content you provide, subject to the rights necessary for us to operate, secure, and support the service.
8. Security and infrastructure limitations
We use reasonable efforts to keep the service available and secure, but no service can guarantee uninterrupted operation, zero downtime, or perfect performance.
Because OpenBandwidth may depend on third-party model and infrastructure providers, outages, throttling, maintenance events, and hardware-level issues may affect service quality.
9. Disclaimer of warranties
The service is provided on an as-is and as-available basis to the maximum extent permitted by law.
We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement except where such disclaimers are not legally permitted.
10. Limitation of liability
To the maximum extent permitted by law, OpenBandwidth will not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or business opportunity.
Our aggregate liability for any claim relating to the service will not exceed the amount paid by you for the applicable service during the six months preceding the claim, unless a different limit is required by law.
11. Suspension and termination
We may suspend or terminate access if you violate these terms, create legal or operational risk, abuse the service, or fail to pay applicable fees.
You may stop using the service at any time, but stopping use does not automatically entitle you to a refund.
12. Changes to the terms
We may revise these terms from time to time. Continued use of OpenBandwidth after updated terms are posted means you accept the revised version.
